Benji Martin Jr., 29, of Garner is accused of killing Smith during a struggle over a gun. Martin was also shot and is being held without bail in the Wake County Detention Center. The search warrants reveal that Smith had received little training in handling mental health crises, which he completed less than five courses in his law enforcement career. Martin had recently started working at a Raleigh-based hemp company and had recently been fired from the Knightdale Police Department for policy violations.
